MIERS MUST DEMONSTRATE SUPPORT FOR FUNDAMENTAL RIGHTS
Statement from Liza Dube, Political Director, NARAL Pro-Choice New Hampshire CONCORD, NH - NARAL Pro-Choice New Hampshire said the public expects Harriet Miers, President Bush’s second nominee for the Supreme Court, to demonstrate that she shares retiring Justice Sandra Day O’Connor’s commitment to fundamental freedoms, such as the right to privacy as guaranteed by Roe v. Wade. Miers does not appear to have a public record to assure New Hampshire’s pro-choice majority that she is a moderate in the tradition of Justice Sandra Day O’Connor, who was the critical swing vote that protected women’s reproductive health and freedom. This is especially critical as we near the hearing date for the Ayotte case, which will determine whether health protections are necessary in abortion restrictions based on New Hampshire’s only abortion restriction on the books. The Ayotte case has the potential to strip away one of the primary protections of Roe v. Wade without directly overturning it. The last decision made in a similar case came down to a 5-4 split with O’Connor as the swing vote. It is imperative that members of the Senate Judiciary committee ask the tough questions necessary to determine that Miers will continue the O’Connor tradition of independence, moderation, and reason.
