NARAL Pro-Choice NH Opposes Nomination of Samuel Alito to US Supreme Court

Samuel Alito Nominated to Replace Justice O'Connor:
Pro-Choice Americans have relied on the independent decision making of Justice Sandra Day O'Connor since she became the first female justice on the Supreme Court in 1981. She was often the swing vote on abortion related cases, deciding in favor of the right to privacy and a woman's right to choose.
President Bush has bowed before the radical right by appointing a nominee who will threaten our fundamental freedoms.

· Alito wrote, “[I]t has been an honor and source of personal satisfaction for me to serve in the office of the Solicitor General during President Reagan’s administration and to help advance legal positions in which I personally believe very strongly. I am particularly proud of my contributions in recent cases in which the government has argued in the Supreme Court . . . that the Constitution does not protect a right to an abortion.”

· In 1991, Alito ruled that several significant restrictions on a woman’s right to choose are constitutional (Planned Parenthood of Southeastern Pennsylvania v. Casey).

· Alito would uphold state laws that place significant roadblocks in the way of women seeking abortion care. Alito concurred with the majority’s opinion in Casey that concluded that “time delay, higher cost, reduced availability, and forcing the woman to receive information she has not sought,” although admittedly “potential burdens,” could not “be characterized as an undue burden.” This opinion practically ensures that he would never find any burden to be undue.

· If confirmed, Alito will replace moderate swing vote Sandra Day O’Connor and may be able to rule on NH’s own abortion case before the Supreme Court (Ayotte v. PPNNE) – a case that has the potential to significantly weaken the protections of Roe v. Wade.
